De Facto began as small jam sessions after At the Drive-In shows. The original band consisted of Omar Rodriguez-Lopez, Cedric Bixler-Zavala, Ralph Jasson, and Jeremy Michael Ward playing local shows around their home town, El Paso, Texas.  The original name was the Sphinktators.  

Omar met Ikey Owens at a hip hop show. They exchanged numbers and Ikey met up with them, joining on keyboards midshow. After relocating to the west coast, Ikey joined the band full-time.

Following death of Jeremy Ward in May 2003, any future re-groupings of De Facto appeared highly unlikely.  However, in 2024 De Facto played a show with Marcel Rodriguez-Lopez on keys and Teri Suarez on vocals.  Although social media accounts for the band were made there is no further indication of future activity for De Facto.  In 2024 their music was removed from Spotify.
